S.O.
(E) In exercise of
powers conferred under section 5 of the Foreign Trade (Development and
Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy,
2004-09, the Central Government hereby
amends to the ITC(HS) Classifications of Export
and Import Items, 2004-09.
2. After amendment the Policy of the
following EXIM Code will be read as under:-

3. A new Import Licensing Note be inserted at the end of Chapter 29 will be as under:-
“(2) All Narcotic drugs and psychotropic substances covered under this chapter will be subject to the following conditions:
(a) Any narcotic drug and psychotropic substance can be imported under
the Special Provisions for medical and scientific purposes as per Chapter VII-A
of the NDPS Rules, 1985 after obtaining an import certificate under the proviso
to Rule 53 of the NDPS Rules.
(b) Imports other than category (a) referred to
in the preceeding Paragraph will be governed by
Annexure-V to Schedule 1 (Imports) of the ITC(HS) Classifications of Export and
Import Items, 2004-09.”
4. A new Annexure-V
is added to the Schedule
I (Imports) of the ITC(HS) Classifications of
Export and Import Items, 2004-09 as annexed with this
Notification.

In the table:
A- Means import prohibited under Rule 53 of the NDPS Rules, 1985.
B- Means import prohibited save by the Govt. Opium and Alkaloid Factory as per Rule 54 of the NDPS Rules, 1985.
C- Means import requires an import certificate from the Narcotics Commissioner under Rule 56 of the NDPS Rules, 1985.
