Subject : Import of
re-manufactured / second hand capital goods.
Attention is invited to para 2.17 of
the FTP which provides for free importability of second hand capital goods.
2. The Trade &
Industry has represented that customs authorities are insisting upon a specific
licence for clearance of second hand capital goods on the premise that
remanufactured goods are restricted for import. In this context it is clarified that the said restriction is
applicable only to remanufactured goods and not to second hand capital goods,
which are freely importable without a specific licence.
3. To facilitate
clearance of second hand capital goods under free category, a declaration by
the importer at the time of clearance that the capital goods imported are
second hand capital goods and do not fall under the category of remanufactured
capital goods may be accepted by the customs authorities.
4. This issues
with the approval of competent authority.
